Legacy on-site wastewater bylaws to be revoked

Auckland Council will remove its four remaining on-site wastewater legacy bylaws, as confirmed by the Governing Body today.

They will be revoked on 1 November 2018.

The bylaws covered the former council areas of North Shore City, Waiheke, Papakura and Rodney.

Councillor Linda Cooper, Chair of the Regulatory Committee, says the bylaws have been made redundant by the Auckland Unitary Plan Operative in part (Unitary Plan).

“The Unitary Plan on-site wastewater rules have been operative since 2016 and apply to all areas of Auckland. The revocation of these bylaws won’t result in any regulations being removed, as residents of these areas are already required to adhere to the Unitary Plan regulations.”

Consultation process

Auckland Council consulted on the proposal to revoke the legacy on-site wastewater bylaws in August 2018 and public deliberations were held 24 September at Auckland Town Hall. Public consultation included in-person Have Your Say events as well as online and postal feedback forms.

The Hearings panel recommended the revocation based on the following points:

  • The bylaws are redundant to the Unitary Plan regulations
  • Revoking the bylaws introduces no new rules and retains status quo
