Compliance

The Compliance unit is responsible for administering compliance of the Resource Management Act, Building Act, Local Government Act and Auckland Council Bylaws.

Our Compliance teams ensure that people, property, and the environment of Tāmaki Makaurau is safe and protected through education and enforcement of the relevant legislation and regulations.

In the Compliance unit, our Community Safety team provides a presence in town centres throughout the Auckland region. They also respond to low-level nuisance behaviour and ensure that the public know Auckland is a safe place to visit and live in. 

What kind of incidents does the Compliance unit respond to? 

Our Compliance unit is responsible for responding to a wide range of activities, from low-level bylaw breaches like unauthorised signage, to major Resource Management Act offences that require lengthy investigation and prosecution.   

Some examples of activities that Compliance will may take enforcement action over include:

  • pollution events (chemical spills, etc.)
  • tree removals 
  • unconsented building work 
  • illegal boarding houses 
  • dangerous buildings 
  • freedom camping
  • signage 
  • nuisance behaviour 
  • excessive noise and vibration.

How does the compliance unit enforce regulation?

Our Compliance teams take a graduated enforcement approach. This often involves providing education and guidance to individuals and businesses to help them to understand the rules and comply with them voluntarily. This can escalate to abatement notices and infringements. Where offences continue or are of a very serious nature, the council may prosecute offenders.
