In December 2018, a second judicial review application in relation to Chamberlain Park was lodged by the Save Chamberlain Park group, this time in relation to the resource consent obtained by Auckland Council’s Community Facilities department for development of a new playground area at Chamberlain Park.
Auckland Council has considered the points made in the judicial review application and decided to surrender the current resource consent and begin a new consent application process.
Auckland Council Head of Investigation and Design Rob Cairns says the judicial review application identified some aspects of the proposed redevelopment work at Chamberlain Park that should have been considered in more detail during the resource consent process.
“We will take this on board and work with the local board on how we can refine and resubmit a new consent application.
“This does not affect the master plan for the future development of Chamberlain Park, which still stands,” says Mr Cairns.
The judicial review application particularly focuses on the consent application being processed without public notification.
General Manager Resource Consents Ian Smallburn says whilst the application is for public amenities in a public reserve, which will not substantially affect the golf course, the broader context of public interest was a factor which could have been explored further in the notification decision.
Next steps are to prepare and lodge a new resource consent application. The scope of any new application remains to be determined. Actual timing of construction is dependent on consents and cannot be confirmed at this stage.
- Resource consent was granted on 27 September 2018 to construct a new playground area, including associated public amenities (toilets, paths, seating, bicycle parking, signage, barbeques, landscaping, etc) and to modify five existing golf holes and connecting walkways.
- This resource consent is one of three required to implement the Chamberlain Park master plan.
